Accelis Gestion court process

Hi Paxton owners

I've received an email from a Mr Claude Escolano (a french apartment owner) who put me in contact with a Mr Eddy Regnier at an Irish mobile number, based in Swords.

This is in regard to a group of Paxton apartment owners who are challenging Accelis Gestion in court re their request to significantly reduce the current rental.

Just wondering if any members have joined this group/lawsuit and if you are familiar with either of these gentleman or the lawyer mentioned a Mr Francois Lorgeoux who

is based I understand in Nantes.

Hi Kathrina,

I am new here, I live in Cork City Ireland. I have heard nothing about it but I would be willing to help in any way I could. I also have a realation who has a property in Paxton and I think he would be interested in helping also.

I'm wondering if anybody has signed the new lease agreement with Accelis?

Hi Katrina,

I am a member of the above group. Mr Lorgeoux is currently preparing our case but I believe it's possible to join if you do so quickly. You will need to do soe work, providing details of past rents received etc. 

The court action is actually 2 actions. One to prevent a reduction in rent going forward and the other seeking reimbursement of rent raises not given in the past.

Hello, the French lawyer is Maître Lorgeaux and his email is lorgeoux@nametis-avocats.com . I know there are more than 10 on the current list and the first action is for arrears of rent since we began our leases. The other action will be dealt with after Christmas. Expect to pay anything between €2000 and €3000 in total for both actions (depends on how many of us in the end). Well worth emailing him and getting the information anyway. He seems fairly sure that we have a very strong case. Ask me any questions and I’ll help if possible.

I have sent an email to Francois with my rental history, initial purchase details, lease details and a copy of the recent letter from Accelis Gestion.

As Nuala said there are 2 aspects in play - the challenge to the Rent reduction and the potential for back rent.

The more that join the group the cheaper will be the legal cost.

I will provide an update on developments as I receive information.

i also receieved an unsolicited email from Claude and i’ve Emailed Eddy who looks like he is acting as intermediary with mr Lorgeoux.

I’m willing to commit to this ,but is this guy legitimate ? And has anyone paid the €150 and the old payment history ?

Hi, You can deal directly with Mr Lorgeaux. You don’t need to pay anyone else unless you want Eddy’s help.

Should I just email Mr Lorgeaux directly or is Mr Eddy Regnier the Irish go between keeping track of who is part of the group for cost reasons.

Is Mr Lorgeaux happy to communicate in English?

I have been in contact with Francois and he is good to deal with and responded quickly to all questions I raised.

I have signed up to the group case - its €900 plus Vat at 20% - 1,080.

The other case of claiming back Rental due is a seperate piece of work.

Use Google translate and send communications to him in french.

Eddy is based in Swords and speaks perfect english.

I was wondering if anyone had heard anything on the Court proceedings with Accelis Gestion.

I have heard nothing over the last 6 months from Francois Lorgeaux and was wondering if anyone had any update on the french legal /court process.

Hi, I just found this group and, like you all, am concerned about everything going on with Acceslis Gestion.

I purchased an apartment at Residence Paxton back in 2007 on the promise of good and regular returns. We all know and I suspect lost much sleep, as that changed over the years.

A couple of months ago I got through to AG and spoke with a guy about outstanding rents, new paperwork, etc. In essence he told me that AG has no money to pay rent due to covid and most owners are selling, he even asked me if I wanted to buy some apartments!  Last week I received a letter from Valhestia Immobilier, an organisation that I've never heard from before, proposing that I sell for between 2,600 and 3,000 Euros per square metre. I have not yet replied.

Have others received similar letter and offers?  What are your thoughts on holding out past covid?  Are other owners selling?  I'd really like to understand how other investors have dealt with AG, particularly during these troubling times.
