I only recently became aware of the problems of non payment of rent by the new lessee "Olea" for the second quarter of 2009 and am keen to try to take the correct steps to ensure payment is made asap while preventing this happening for future payments.
Whatever those steps are e.g. submitting official demands of payment, dialogue with olea, legal actions etc, it would be better doing this as a unit of owners of the residence.
I am new to this forum, and need to do some catching up on relevant infomation and would be very interested in consolidating opinion, news and developments with regard to the Residence du Golf in Carantec.

Received a letter this morning from the head of the "Association des Proprietaires de la Residence du Golf de Carantec" suggesting a coordinated legal action.
This will require at least 30 owners in the association - this probably is the best way forward and requires us to commission legal representation now which he is trying to get going as soon as possible.

Whilst doing something seems a better option than doing nothing I am not clear exactly what Idrac are proposing to do.
The letter seemed a bit wooly to me.
Olea seem to be out of their depth with DHEILLY at the helm.If Idrac are proposing to oust them and install a competent management company I would be much happier but unless I missed the point the letter didn't say that.

I received the same email yesterday which triumphantly proclaimed I would get paid by 31 Oct 2009.(Gee thanks Olea for doing what you are legally obliged to.)
I read it as both missed payments would be honoured.The problem is that I simply don't feel I can trust the company.They have treated the owners with contempt.It's interesting that DHEILLY wishes to begin dialogue now after he and his shower have ignored me for the last 17 attempts.
I really had to fight the urge to reply to Olea with some serious frank feedback.

I have not seen the letter to which Paul and Ross refer and describe as a 'bit woolly'. I have to assume that it is the Lettre de Mission from Idrac & Associes. I have no hesitation in recommending the services of Maitre Idrac as he has been invaluable in our efforts to obtain payment of outstanding rentals re Beziers (Domaine du Lac) and to set up new management at our Burgundy property (Les Allees du Green, Levernois). Individual actions do not seem to bear fruit and it is essential, according to Maitre Idrac, that owners act together as a group. If one of your group is French speaking, he will deal with owners queries through that representative as it makes life much simpler for all concerned. He speaks good English and understands something if expressed in English when you can't think of the right French word. He will explain to you what your options are under French law which is quite different from English law, I can assure you! If you feel that the Lettre de Mission did not make something clear, take up the issue with Maitre Idrac and ask him to clarify. Individual owners at the Domaine du Lac had engaged their own legal representation and had been battling away for months and months without success. Maitre Idrac stepped in on behalf of a large number of the owners and the result was an instant reaction from Olea.

I am new to this forum. My husband and I have a 3 bed place in Residence du Golf and like many on this forum we have not received payment from Olea.
I have read that some people received something in September. Please could anyone advise on how they managed this? Also I read someone suggest all the owners of Residence du Golf getting together and taking legal action. I am very willing to do this also.

Yes we did receive payment last week. This was in respect of rent due at July. We only got this when a CDP was issued. Unfortunetly there is no point in issuiing any more CDP's as Olea are no longer paying even when the bailiff calls.
We were waiting to see the letter from Olea due Wednesday before taking further action, unfortunately once again they have shown contempt for the owners and have not bothered sending one.
I think as owners we will need to unite and decide on the way forward. I would be surprised if any letter actually arrives from Olea and even if one does I cant imagiine it being good news.

I am willing and able to join with anyone else that wants to try and get a solution for all this. I have emailed Actiim the Syndicate of Co-proprietors and will also be in contact with the company that brokered the deal in the first place. I have also requested my bank manager to speak with Actiim also.
I am not wiling to lose the property and something has to be done. So if you would like to join me and have any other strategies to take please let me know. I shall keep the forum update with any success or otherwise that I get. I ask that everyone does the same. We have to get this sorted out.
Also I wanted to know if our properties were still being rented out? If so that is illegal as they have a breach of contract.

I called Olea every day and even today they told
me that they do not know when they will inform the clients. I recommend now to
join M° Idrac to start sueing Olea to try to get paid for some amount. In fact
it seems that Mr Deilly is looking for new financial partners in order to pay
what is due. I am frankly very negative here and do think that they may enter
into receivership before Xmas.

Hi All,
I just wanted to post information regarding what we are planning to do with the situation. I contacted our accounts, GEFI and they replied with the following information:
There are several possibilities:
Some which have no consequences on the VAT claimed in reimbursement at the beginning as:
•
Continue the activity of furnished renting with another Management
Company (the law specifies that the observation time given by the law
court can go on from 6 to 18 months if the Company makes bankrupt).
•
Create a Group of owners in order to defend yourselves with the
partnership of a lawyer specialized for this kind of matter (we can
give you the details of a lawyer).
• Take contact with some other Management Companies which are able to propose you a new lease back submitted to VAT.
Some which involve a repayment of VAT refunded at the beginning as:
•
Continue the activity of furnished renting by your own or with a real
estate but without 3 of the 4 Services which permit to be submitted to
VAT. In that case, the rents won’t be submitted to VAT anymore, but
you’ll continue to deposit declarations in matter of BIC only.
•
Stop the activity: some formalities of cessation and the last
declarations in matter of BIC and VAT must be done within 60 days which
follow the date of cessation.
For those last 2 cases, your rents
won’t be submitted to VAT anymore, and so, you’ll be indebted to the
TRESOR PUBLIC, for an amount of VAT by twentieth, which is about 16
004.36 € (22 863.37 x 14/20 for the property).
We are going to go with the lwyers recommended by our accountants that have served us for the last 4 years, we feel more comfortable with that and we will also ask our accountants about the different possibilities of new Management Agencies so we can get some idea regarding the types of occupancy rates we can achieve with our property and if it will cover the rent.
I received some private emails regarding some owners interested in joining us with this process. More are welcome, we definitely have power in numbers. AS soon as I get more information regarding the recommended lawyer from our accountants I will contact those that have been in contact with me directly to pass on information or get more information to pass on to the lawyer.
