As anyone received their 4th quarter rent for 09 and the 1st quarter rent for 2010 yet. I have sent numerous emails to anna and she doesn't reply. I have tried to phone her and there is no reply. I have now sent an email to the central reservations but no reply. Does anyone know are they still tradingGerardy

Another concerned owner here awaiting receipt of my rental arrears.


I am in constant communication with Anna who is not able to confirm payment dates and provides little or no explanation only to say "there is no money". I have requested several times for Mr.Lion to communicate the reasons for the late payment of our rental but to date have had no response.


I stopped paying the maintenance charges to Phoenix but the amount was deducted in full from one of my rental payments back in 2009.


In my opinion the rental arrears seem to have escalated since the Callan Development commenced which gives me great cause for concern.

French frustated Clos Dia 2 owner here. I live 100 km from le clos dia 2 and received a few days ago a letter saying there is a rental reduction.
I totally agree with Martino : only an association may have a chance to defend our right; I am at the moment trying to find a good laywer.

i'm also an unhappy owner in clos dia II and haven't been paid for qtr 4 2009.


there must be some way of changing this arrangement to get people in who can run the business.


my further worry is that last year they said they were booked out over the summer but no rental money appeared so i'm not optimistic about ever seeing rent in the next few years.

Everyone has received this letter but no one has signed it as we are seeking to negotiate with the management company.


We have an association of over 80 owners from Ireland, UK, Dubai, Netherlands and France.

Yes, it's there. The Management Company is Camiole Resorts, the Residence is Les Clos de Tourettes.

Hello everyone. Yet another frustrated Clos Dia owner

here.

I have been "fighting" with Camiole for 2 years now and

am way passed being fed up. It appears we are numerous

here with the same problem (see also

have already got in touch with another owner based in

France and we are looking at establishing an association

in order to defend our rights. I would like to know if

anyone is interested in joining in.

If it is in relation to Clos Dia I did receive rent for quarter four but don't expect to get anything for quarter one for some time yet!!

I am new to this forum but just wanted to voice my concern.

I am in Clos Dia phase 1 and I am still awaiting payment from Q4 2009

onwards.

Are there others out there?

The temptation is to withhold payment demands from Phenix until rental

paid however I'm sure we will be the only losers if we all start playing

that game.

I have emailed Anna but never receive replies. Has anyone looked into the

legal side and the maximum time they can retain rental for without

consequences?

Also was anyone in attendance for the last AGM?

I have been trying to contact Anna for some time by email and phone and finally got to speak to her on Friday. I asked why I had not been paid and she said they have no money. They are fully booked for July and August and she hopes to get some money in a few weeks and hopefully will be able to pay quarter 4. I asked was company in diffs she said no but things are difficult they have no bookings for September. She said a lot of leaseback companies are in difficulty and do not pay however they do pay but they pay late. She had not been replying to my emails and I asked why as it is very frustrating and she said she is extremly busy and has hundreds of emails each day looking money. Hopefully we will have quarter 4 soon but they are getting later and later with payments. She did say some people had been paid Q4. I told her I did not think they advertised well enough as when you google self catering in south france nothing comes up for them. I have suggested to her that she should advertise on sites like www.holiday-rentals.co.uk to try to reach Irish and UK people. But with language barrier I don't think she understood. It is a lovely place and should be popular with holiday makers. I know we went to it for a week with the kids and it was great for them.

I am pleased to say that since accepting our revised (lower rent) lease agreement, the rent has since been paid bang on time.


Let's hope that Camiole soon find themselves making a decent profit, and that we can put the rents paid to us, back up as per the original lease agreement.


Does anyone know anything about the new arrangement wherby MMV are running the residence?

Iam another victim awaiting payment for the last quarter of 09 and have been told it will be some time before we receive payment. I feel as a group of owners we have been remiss in not attending the A.G.M. or at least employing a representative who can nogotatiate in French on our behalf. It would appear that we have agreed to give the Management Company the power of attorney on any decision which has to be made this has resulted in Camiole employing Phoenix to look after maintenance in the common areas which was not part of our agreement when purchasing. It also looks like we can be fined if payment is not made on time and these charges can be deducted from the rent. I think it is time that we form a syndicate to bring pressure on the management company to adhere to our lease aggrements as payments are drifting out further and further which must be brought under control or alternative agreements be rengotiated.




Olly, not sure if payments being on time are just due to lower rent agreement, or also to the fact that Lion is no longer running the company. We were tricked into accepting him as manager, while it turned out he is a builder with no knowledge of the travel business.
