I hope somebody can help me. We bought a leaseback

property in Horizon Bleu, Theoule in 2006 and 3 months

ago the money

stopped being paid into our bank account. I tried to

trace the company that paid so far, but can not get a

response from anyone. The company originally involved

Azur Assistance, sold it to another company and I fear

they are all no longer trading.

Azur Assistance:

“We have sold this program under the mandate of a company

called "C'est la vie properties" with no direct contact

I hope somebody can help me. We bought a leaseback

property in France in 2006 and 3 months ago the money

stopped being paid into our bank account. I tried to

trace the company that paid so far, but can not get a

response from anyone. The company originally involved,

transferred it to another company who transferred it to

another company and I fear they are all no longer

trading. I also wrote to the notary but have had no

response from him either. We are now paying the

mortgage, but we're not in financial position to do so.

I have been reading the posts here about French banks chasing people in Ireland after they have handed back the keys of their French property. I have also read that most French mortgages are non-recourse which means the individual is not liable after they hand the property back. If this is the case how can French banks chase the borrower if they had a non-recourse mortgage?

SELLING LEASEBACK

I have a leaseback property 50 / 50 with a colleague. The

leaseback agreement expires October 2013. We are wanting to

sell and have been advertising for around two years with

very little interest. We don't know whether to sit it out

until the agreement ends or try like hell to sell ! Surely

it is tempting for any potential investor to buy now with

only a short time to go on the leaseback ?

Notice of income tax

I have a french leaseback and received a form entitled in

French Notice of Income tax 2011 from centre des finances

publiques in September. Their is a place for my signiture

at the bottom and states also that Votre situation is 0€.

Should this form be returned to the French tax authirity.

Can anyone advise.

Renewal of Lease

If one chooses to renew the lease does it have to be on the same terms? Why can't owners renegotiate the terms of the lease and if they can't agree terms either terminate or enter into a lease with another company?

Someone out there must have been through the process of what happens if they don't renew or can't agree renewal terms?

Demand for TVA on selling

Wonder if anyone can advise? We have a buyer for our French leaseback. The buyer originally had planned to go with the management company but has now decided not too. Our french estate agent has told us that the tax authorities rarely ask for the TVA to be repaid! Is this true?

My French leaseback experience has been an absolute disaster. I no longer trust the management company to continue delivering the agreed rental amounts & am hugely stressed by the whole situation and uncertainty.

My strong preference at this stage is to just take the financial hit & lose what I have already invested and default on the mortgage (nearly 360k) with Credit Immobilieir de France.

law and 3 year contract termination

hello all I am new to the forum

I did search to see if there was anything about this subject but failed to

find anything.

I am sure I have seen somewhere there was a change in the french law

about companies being able to terminate the contract at the end of 3

years. I know this was not going to retrospective but would like to know if

I am right and if so when the change happened. We are busy comparing

lease contracts in our leaseback community and have found differences.

SELLING LEASEBACK

I take on board previous comments regarding long term

investment of leaseback properties. However, due to the

property market crash and the general financial position of

many countries, trying to sell my leaseback before end of

contract has become a nightmare. I have had three enquiries

in the last two years, offering silly amounts of money. I

am advertising with several agents without much success.

Any ideas ?
