Hi there, I am looking at leasebacks in france. Not sure yet where. Obviously i want to check out what tax implications there are with leasebacks. Could somebody provide me with a list of all the taxes that i would be liable for both here and in france should i decide to buy a leaseback property in france.

I understand that if i have a french mortgage that this can be offset against tax on rental income in france. So if there is zero tax payable to france is it zero to Ireland too?

Withdrawing From A Sale

There have been several delays in buying our Leaseback in Theoule Sur Mer. This has included that we still have not received the signed copies of the contract back. The developer says they were sent but it was when we were away. They have never arrived. As time has gone on with delays I have considered pulling out of the sale. Can anyone confirm as I have never received the contracts can I pull out under the 7 day cooling off period as it effectively never began.

If anyone has paid any tax in France that they think they should not have paid, you only have until 31st December of the year following the year in which you paid the disputed tax, to reclaim it. It is also your responsibility to ensure that you pay any taxes due. The tax office does not always tell you what taxes are due or when they are due.

Refurbished Leaseback

Can anyone help with the following please re. a leaseback that is a refurbished property as opposed to a new build?:

What building defects guarantee should one expect on a refurbished property? Does the vendor have to undertake / make available a condition survey or similar prior to sale?

During the lease does the management companys' repair responsibility extend to structural repairs and exterior decoration as well as internal upkeep?

 

 

Taxe Professionnelle

It's official! Taxe Professionnelle must be paid by the management company and not the private owner. Following a court ruling in April this year, I have received a rebate for the TP I paid in 2005. I don't know what's happened to the TP I paid in 2003 and 2004 but I suppose it's a start!
