Late Payment of Rent

Recently our management company advised that if we are late paying the maintenance charges that they will add penalties which are very significant. They also passed a resolution at the AGM that stated that they could seize overdue payments for the rent cheques.

Does anyone know if this is legal.

Also can anyone advise if we are entitled to charge interest where rent due is late

Leasebacks 2010

Hi All.

I have read all the negative stories about leasebacks on this forum and I sympathise with anybody who has found themselves in difficulty with a leaseback property.I bought 2 different leaseback properties in 2005 (different management companies etc,) and thankfully both are functioning as they should.The rent is covering capital mortgages on both properties.Just wondering what people think, would I be crazy to consider a 3rd leaseback?

Who receives or collects and keeps the 55.% & 19.6% (assume this is VAT)

on the rental?

I have property with parking which is 100% leased out as I have no

personal usage. I receive the 5% rental from the management company

which amounts to 5352 euros as per the bail de commersial. They have

this year for the first time, sent me an annual statement quoting:

Loyer TTC 6340 euro;

Loyer HT (5.5%) 5519 euro;

Loyer HT (19.6%) 433 euro;

TVA @5.5%303 euro;

TVA @19.6% 85 euro:

Please be aware that the deadline for filing a claim in L'Atrium's Receivership proceedings is, for overseas-based investors, 2 February 2010.

Claims should be submitted, by registered mail (with a receipt for the addressee to sign), to:

Non renewal rules change

Hi. I'm currently at the final stage of signing for a leaseback with the Notaire. I have been asked to sign an additional document because of changes to the compensation rules for non renewal of a commercial lease which came into force on 23 December 2009. Does anyone know what these mean and if they are positive?

The second paragraph of Aricle L145-14 details the possible compensation for non renewal:

Hi there,

According to my due diligence, I decided not to buy with lavagnac

development :

7% return during 23 years based on EUR 6500 / sqm is simply not

sustainable for the Address, the management company from Dubai which

knows nothing about France (especially the very high labor costs)

the developper is english and not French : I 've always heard that a good

developper is most of the time a national or local. ie. i ve talked with a

cafe tenant and a winemaker in pezenas complaining about this modern

architecture
