Style for yearly management contract

I have a leaseback in Normandy at haut Val, Belleme. I dont know if there are any others here in the group.  We have been through the usual trauma with the mangement company going bust and cancelling the leases back in 2011-12 with the further complication that not all of the site was finished.

There is a hotel on site that was taken over by DCG but the terms they offered us at the time were so bad that a number of us refused to sign a fresh lease with them.

Mandat de gestion

I have been offered a mandat de gestion contract by my management company with the cancellation of my 1 year old leaseback contract without any indemnity charge.The one provision is that I must include a min of 50% of the winter school holiday periods in the availability of my apartment. As from next year this is no problem for me as my son leaves school this year.

If I understand correctly, i can offer my apartment to the management company for all of the winter school holiday periods under the contract and use the apartment as i wish for the rest of the year.

Increasing nr. of high season weeks

Just wondering whether other complexes have had this happen.

Over the last few years, our management company have been decreasing the number of low season weeks on the calendar and replacing them with high season weeks making it more difficult and more expensive. This seems to be a way of screwing us without affecting the contract. There is of course no mention in the contract of how many low season weeks should be in the contract.

Anything we can do about it?

AGENTS FEES FOR SELLING PROPERTIES

I know that French estate agents charge up to 10% (plus VAT) of the sales prices -and there are other fees.

But I'm hearing that it is common practice for agents to insist on a minimum fee. I asked a couple of my fellow owners if they had been charged a minimum fee and two of them produced correspondence from Sextant properties which showed "minimum fee €10.000 plus 20%  VAT".   Considering these owners are trying to sell small apartments for ca. €40.000 a sales commission of €12.000 seems outrageous.

Can anyone confirm if this is the norm?
