My leaseback up for repossession

Hi i need advise regarding my leaseback. Due to bad times i had to stop paying my french mortgage and now i have received a court order saying unless i pay it off in 8 days it will be reposssessed. I have been worried sick about it for a long time now and with redundancy and near marriage break up i just couldn`t afford it anymore so let it go into big arrears. I personally don`t own my house in Ireland it belongs to my wife and her mother and my wife had no dealings with the property in France and the mortgage was only in my name.

Can anyone advise me. Our management company is late again with our annual rental payment.Can I use this as a reason to give notice and terminate my contract??

If yes how do i do it and how do i pay back the VAT,

Am I right in thinking the VAT decreasees over the years?? Any help would be good.

Buying additional weeks

Does anybody know whether you can buy additional weeks on a permanent basis? We have 1H/1M/1L in the Winter and would like to have 3 more weeks - without having to pay extra each year ie pay a lump sum up front.

Well folks...it's gone! After 11 years of misery and worry I'm rid of the millstone that was 'Leaseback'. I lost over €22,000 over the 11 years of ownership (money in V money out) and the worry of it has been incalcuable. I feel as if I have paid someone €22,000 to torture me for 11 years!

Rules for repaying TVA if lease is terminated

I read with interest in an article by Fabien Cordiez linked to from the forum a while ago that new rules came into force in 2010 to help leaseback owners faced with repaying the TVA on their build if they exited leaseback. I am sure that the article said that there was a one year grace period to get either a new lease in place or an owners cooperative, but if you didn't want to continue in leaseback at that stage, the proportion of TVA outstanding could be paid back over 3 years instead of being payable immediately. I rent a property with lagrange in Morgat and my rentals were paid to me VAT excluded...Is it normal?

Lagrange told me it was because of this new law (283.1) but I'm not sure they are allowed to do this ?

Does anyone in the same situation?

Title Deeds of Leaseback Property

I have a copy of the title deed of my leaseback property signed by the French Notaire at the time of purchase. I have been trying to find out from the Notaire whether or not he possesses the original title deed. I have sent may e mails to his firm and have also telephoned them because noone was responding to my e mails. The person I spoke to said he would look into the matter and get back to me which he hasn't.

Termionation of Lease by Management Comp

Hello all

I wonder if anyone can help me.

I was reacently served with a notice to terminate the lease by the management company. I think it was served late so that may help me out, however, even if I can get another 3 yrs out of them the problem will remain the same when I presume they will terminate again in another 3 yrs.

So what happens on termination? I have no idea where to go from there as it was a complete surprise they could do this - I was never advised of their right to terminate every 3 yrs. I am panicing to say the least.
